By using PropertyList.es, you agree to these Terms and Conditions. If you do not agree, you should discontinue use of the platform.


PropertyList.es is designed to facilitate property listings and lead generation for real estate professionals in Spain.

Section I: Introduction & Definitions

1.1 Introduction
Welcome to PropertyList.es, your comprehensive property listing platform tailored for the unique and diverse real estate landscape of Spain. By accessing or using our platform, you acknowledge and agree to abide by these Terms and Conditions, alongside all relevant supplementary policies and agreements.

1.2 Definitions & Interpretations

  • “Platform” refers to PropertyList.es, including its website, mobile apps, tools, and associated services.
  • “Member” refers to real estate agents, agencies, or affiliates registered on the platform.
  • “Listing” refers to property descriptions, images, and relevant data uploaded by members.
  • “Services” refers to features, tools, and functionalities available on PropertyList.es.
  • “Us,” “We,” or “Our” refers exclusively to PropertyList.es and its operating entities.

Section II: Registration, Account Creation & Management

2.1 Eligibility & Registration
To register, users must be 18+ years old and legally permitted to operate within the Spanish real estate sector.
PropertyList.es may verify registrations and request supporting documentation. Agencies from any EU/EEA country may register on the platform, provided they are legally authorised to operate in the real estate sector in their jurisdiction. By registering, foreign agencies confirm compliance with all applicable local laws, professional licensing requirements, and regulatory standards in their country.


Account Acceptance & Agreement

By creating an account, clicking “I agree”, or otherwise using the Platform after being shown these Terms, you accept these Terms and confirm you have authority to bind the entity you represent. PropertyList.es records and retains users’ acceptance (including the version of Terms accepted, user identity and timestamp). By creating an account or using the Platform, you agree to these Terms. If you do not agree, you must refrain from creating an account or using the Platform.

2.2 Account Authorisation
By registering on PropertyList.es, you represent and warrant that you have received express authorisation from the estate agency or company you represent to open and operate an account on this platform. You acknowledge that any account created without such authorisation constitutes a breach of these Terms, and you assume full responsibility for any claims, damages or losses arising from such unauthorised actions. In the event that an account is found to have been created without proper authorisation, PropertyList.es reserves the right to immediately suspend or terminate the account without prior notice. Furthermore, PropertyList.es shall not be held liable for any claims or losses arising from the unauthorised use of an agency’s name.
2.3 Account Security & Integrity
Members are responsible for maintaining the confidentiality of their account credentials, including passwords, and for all activities that occur under their account, whether authorised or unauthorised. Members must promptly notify PropertyList.es of any unauthorised access or suspected security breaches. Failure to do so may result in the member being held liable for any consequences arising from such activities.
2.4 Right to Refuse Service
PropertyList.es reserves the right, at its sole discretion, to refuse, suspend, or terminate access to its services to any individual or entity, for any reason or no reason, at any time, without prior notice or explanation subject to mandatory consumer protections. This includes, but is not limited to, the refusal of listings, removal of existing listings, suspension of accounts, or denial of platform access. PropertyList.es is not obligated to provide any justification for such actions and shall not be liable for any consequences arising from the exercise of this right.

Section III: Content, Listings & Proprietary Rights

3.1 Listing Protocols & Compliance
All property listings must comply with regional real estate laws and regulations and must be authorised by the property owner. PropertyList.es reserves the right to review and audit listings for compliance. If a listing is found to be non-compliant, PropertyList.es may, at its sole discretion, take one or more of the following actions:
  • Remove the listing without prior notice.
  • Suspend or terminate the member’s account.
  • Impose a penalty, which will be notified to the member.
Members agree to cooperate fully with any compliance audits or investigations conducted by PropertyList.es.
While PropertyList maintains a Zero Tolerance policy for fraud, for suspected clerical or non-intentional data errors (e.g., a clear pricing typo), PropertyList may, at its discretion, issue a ‘Notice and Cure.’ The Member will have 24 to 48 hours to rectify the error before the listing is removed or further sanctions are applied.


3.2 Content Usage & Rights Allocation

Members retain ownership of the content they upload to PropertyList.es. However, by uploading content, members grant PropertyList.es a perpetual, royalty-free, worldwide license to use, display, and promote the content for marketing and operational purposes. This license remains in effect even after a listing is removed by the member, unless the member formally requests in writing to revoke the license for future promotional use. PropertyList.es will honour such requests within 30 days of receipt, but previously published promotional materials may not be retracted. Use of shared Listing content by other Members is governed by clause 3.9.
3.3 User-Generated Content & Liability
Members are solely responsible for ensuring that all content they upload, including property details, images, and descriptions, is accurate, up-to-date, and does not infringe on any third-party intellectual property rights (e.g., copyrighted images, trademarks, or other proprietary materials). Members must obtain all necessary permissions and licences before uploading any third-party content. PropertyList.es is not liable for any claims arising from the unauthorised use of third-party intellectual property. Members agree to indemnify and hold harmless PropertyList.es, its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of their use of the platform or the uploading of any content that infringes upon third-party intellectual property rights or violates applicable laws or regulations.

3.4 API & XML Feed Subscriptions
PropertyList.es may integrate with third-party services such as payment processors, CRM systems, or MLS databases. Users acknowledge that PropertyList.es is not responsible for the performance, security, or data handling of these services.

3.4.1 XML Feed Subscription
The XML Feed Subscription is an optional, paid integration intended for technically skilled members. By subscribing:

  • You are responsible for installing, configuring, and maintaining the feed.
  • PropertyList.es provides documentation and automated endpoints but does not provide on-site installation, bespoke integration, or custom development.
  • Use of AI-generated code, third-party plugins, or external consultants is at your own risk. PropertyList.es is not liable for errors, data loss, or misconfigurations caused by subscriber actions.
3.4.2 Support & Service Levels
Basic documentation and email support are included. Additional development or troubleshooting is treated as paid professional services.

3.4.3 Ownership & License
Members retain ownership of their content. Enabling the feed grants PropertyList.es a licence to distribute the data as needed to provide the service. Resale or redistribution to third parties requires a separate written licence.

3.4.4 Refunds & Termination
Feeds are non-refundable except when PropertyList.es is demonstrably at fault. Access may be suspended or terminated for abuse, security issues, or non-payment. Subscribers must maintain backups of all imported or replicated data. Refunds may be given in credits at PropertyList.es’ discretion.

3.4.5 Changes
PropertyList.es may modify feed formats or endpoints, providing at least 30 days’ notice for backward-incompatible changes.

3.4.6 Limitation of Liability
PropertyList.es’s liability is subject to Section X of these Terms.
PropertyList.es is not responsible for the legality, licensing, or regulatory compliance of agencies operating in or outside Spain. Users operate at their own risk, and the platform disclaims any indirect or consequential damages arising from regulatory or legal requirements.

3.4.7 XML Feed - Operational Terms & License
(a) Feed Spec & Access. PropertyList.es will publish a versioned XML feed specification and issue access credentials (API key) to subscribers. Subscribers must secure their API keys and are solely responsible for key confidentiality; compromised keys may be revoked.
(b) Rate Limits, Monitoring & Logs. PropertyList.es may enforce reasonable rate limits and require logs, diagnostics or evidence to investigate issues. Continued abuse, excessive usage or behaviour that threatens platform stability may result in temporary suspension of feed access.
(c) Installation & Support. Subscribers are responsible for installing, configuring, testing and maintaining the feed on their systems. PropertyList.es supplies documentation and basic email support. Custom integration, on-site configuration, bespoke development or troubleshooting beyond documentation is not available.
(d) License & Redistribution. Members retain ownership of listing content. By enabling the XML feed you grant PropertyList.es a limited licence to distribute the member’s data for feed delivery. Subscribers may not re-sell, re-syndicate, sublicense or provide the feed to third parties without a separate written licence from PropertyList.es.
(e) Backups & Data Loss. Subscribers must maintain backups of any data imported from the feed. PropertyList.es is not liable for loss of subscriber copies or derivative data.
(f) Changes & Notice. Backward-incompatible changes to feed formats or endpoints will be announced in writing at least 30 days in advance; PropertyList.es will make reasonable efforts to support prior formats during transition.
(g) Liability. Subject to applicable law, PropertyList.es’s liability in relation to the XML Feed is limited as set out in Section X. Subscribers accept the operational risks of self-installation and third-party integrations.

3.4.8 APIs and Data Services (Market Data API, Website API)
In addition to the XML Feed, PropertyList.es offers programmatic interfaces, including a market-data interface (currently published at mcp.propertylist.es, the "Market Data API") and a website API used to display PropertyList data on member and third-party websites (the "Website API"). The following terms apply to all such interfaces. Use of the Market Data API is also subject to the API Terms of Use, which apply to every user of that interface, whether or not that user holds an account with PropertyList.es.
(a) Access and keys. Access is granted by an issued key. Keys are personal to the member or application to which they are issued, must be kept confidential, may not be shared, resold or transferred, and may be revoked or rotated by PropertyList.es where they are compromised or misused. Keys may be issued subject to acceptance of the API Terms of Use.
(b) Acceptable use. PropertyList.es may set and enforce rate limits, quotas and monitoring. You may not use the interfaces to carry out bulk extraction or systematic copying of listings, to populate any website, application, feed, portal or marketplace with listing data other than through your MicroSite, a Website Builder site, the Website API or an XML Feed subscription as described in (c) and in clause 3.9, to build or populate a competing database or portal, to re-sell, re-syndicate or sublicense the data, or to circumvent any technical limit, authentication or access control.
(c) Permitted purpose of the Market Data API. The Market Data API is provided for research, analysis, market discovery and answering questions about the Spanish property market, including by AI assistants and similar tools. It is not a content feed. It may not be used to populate, publish or display property listings on any website, application, feed, portal or marketplace, whether your own, your agency’s or a third party’s. Publishing PropertyList listings on a website is available only through your MicroSite, a Website Builder site, the Website API or an XML Feed subscription, on the terms applying to those services, and only in respect of listings you are entitled to market.
(d) Attribution. Where information obtained through the Market Data API is shown to an end user, it must be attributed to PropertyList and, where an individual listing is identified, must link to that listing on propertylist.es or on the marketing website of the listing agency. Attribution and links may not be removed, obscured, replaced or presented so as to suggest the information originates elsewhere.
(e) Caching and retention. Responses may be cached for up to 24 hours for performance. Listing data may not be retained beyond that period, and no persistent copy, index, embedding store or derived database of listings may be maintained. Aggregate market statistics may be retained where they cannot be used to reconstruct individual listings.
(f) Listing content and AI assistants. Interfaces made available for public or partner use may surface listing and market information to third-party applications, including AI assistants and similar tools. By publishing a listing on the platform you grant PropertyList.es a licence to make that listing available through these interfaces for the purpose of promoting the listing. You may ask us to exclude your listings from such interfaces by contacting MLS Support.
(g) Personal data. Agent names, telephone numbers, email addresses and any other personal data returned by the interfaces may not be extracted, stored, enriched, published or used for marketing, prospecting, lead generation or the building of contact databases. Any processing of personal data obtained through the interfaces is subject to Regulation (EU) 2016/679 and applicable Spanish data protection law, and you act as controller in respect of that processing.
(h) Data accuracy. Market data, area statistics, price-per-square-metre and Price Oracle figures returned by these interfaces are estimates and indicators only, on the same basis as set out in the section headed No Professional Advice; Market Data and Valuations.
(i) Changes and availability. Interfaces may be versioned, changed, deprecated or withdrawn. PropertyList.es will make reasonable efforts to announce breaking changes in advance. No uptime guarantee applies to these interfaces except where expressly stated in these Terms.
(j) Suspension. Access may be suspended or terminated immediately for abuse, security risk, excessive load, failure to attribute as required by clause (d), or breach of these Terms or of the API Terms of Use.

3.5 Intellectual Property Rights
All intellectual property rights, including but not limited to trademarks, logos, designs, software, and proprietary technology associated with PropertyList.es, are the exclusive property of PropertyList.es or its licensors. Users are granted a limited, non-exclusive, non-transferable licence to access and use the platform in accordance with these Terms & Conditions. Any unauthorised use, reproduction, or distribution of PropertyList.es’s intellectual property is strictly prohibited and may result in legal action.

3.6 Third-Party Services & Liabilities
PropertyList.es is not responsible for any disruptions, errors, or issues arising from third-party services integrated with the platform, including but not limited to payment processors, CRM integrations, or MLS databases. Any claims arising from such services should be directed to the relevant third-party provider.

3.7 IP Protection & Takedown Procedure
In cases of suspected intellectual property infringement between members (e.g., unauthorised use of photographs or descriptions), the aggrieved member may submit a ‘Takedown Request’ to MLS Support. PropertyList reserves the right to hide or remove the disputed content pending an investigation. PropertyList is not an arbiter of legal title but will enforce platform-wide standards to prevent content theft.

3.8 AI-Generated Content and Outputs
Certain features use artificial intelligence to generate or assist with content, including the generation of listing text and details from photographs and voice recordings, property reports and valuations, market and area content, and property matching.
(a) Outputs are drafts. AI-generated output is provided as a draft for you to review. You remain responsible for checking it for accuracy and for ensuring that anything you publish complies with clauses 3.1, 3.3 and 7.2 and with all applicable law.
(b) Ownership. PropertyList.es does not claim ownership of the listing content you publish as a result of using these features. Clause 3.2 continues to apply.
(c) No warranty. AI output may contain errors, omissions or inaccuracies. Reports, valuations and estimates produced by these features are indicators only and are not a formal or regulated valuation, appraisal or tasacion, on the same basis as set out in the section headed No Professional Advice; Market Data and Valuations.
(d) Processing. Photographs, recordings and text you submit to these features may be processed by third-party AI service providers acting as our data processors under a data-processing agreement. Details are set out in our Privacy Policy.

3.9 Marketing of Shared Listings by Other Members
This clause applies to every Listing that a Member has shared on the MLS, meaning a Listing that is not marked “Do not share with other agents”. A plain-language guide is published at Using shared listings in your marketing.
(a) Licence. The listing Member grants each other verified Member a non-exclusive, revocable, royalty-free licence to use the Listing’s photographs, description, key facts and floor plans (“Shared Content”) to market that property for sale or rent, for as long as the Listing remains shared and live on the Platform. The licence covers the marketing Member’s MicroSite, Website Builder site and own website fed from the Platform, Instant Brochures, and the marketing Member’s own organic social media channels.
(b) Not covered without written permission. The licence does not extend to paid advertising of any kind, including boosted posts and paid placements; to video, virtual tours and 360 content; or to syndication of the Listing to any third-party property portal, marketplace, feed or database. Syndication of a Listing to external portals remains exclusively with the listing Member. Permission for paid advertising or video must be obtained in writing from the listing Member for each Listing, and requests may be routed through MLS Support so that both parties hold the record.
(c) Conditions. Every use under (a) must: (i) carry the marketing Member’s own brand, reference code and enquiry route, and must not present the property as the marketing Member’s exclusive instruction; (ii) show the asking price and status currently published on the Platform; (iii) leave the property as photographed: no removal or covering of watermarks, no AI staging, virtual renovation or other alteration presented as the current condition, and no combination of images from different properties, while cropping, text overlays, carousels and collages of the same property are permitted; (iv) comply with applicable advertising law, including the display of the energy performance rating where required by Real Decreto 390/2021; and (v) never include the listing Member’s internal reference, any personal data of the seller, landlord or occupant, or the property’s exact address unless the Listing itself publishes it.
(d) Withdrawal. The licence ends automatically when the Listing is withdrawn, sold, let, marked “Do not share with other agents” or removed from the Platform. The marketing Member must stop any paid activity immediately and remove, or mark as no longer available, every published post within seven (7) days. The listing Member may additionally require removal of any specific post at any time by notice through MLS Support, and the marketing Member must comply within 48 hours.
(e) Warranty and indemnity. By sharing a Listing on the MLS, the listing Member warrants that it holds all rights needed to permit the uses in (a), including from any photographer or other rights holder, and indemnifies Members who use Shared Content in accordance with this clause against third-party intellectual property claims arising from that content. PropertyList.es gives no warranty of any kind in respect of Member content and is not a party to, and has no liability under, any licence between Members.
(f) Third parties. A Member may have its marketing carried out by an employee, assistant or marketing agency under clause 7.4 and remains fully responsible for their compliance with this clause. The licence is not transferable and may not be sublicensed.
(g) Opting out. A listing Member excludes a Listing from this licence by marking it “Do not share with other agents”, which also removes it from the MLS and from other Members’ sites and feeds. Private listings are subject to the charges published on the Platform; see Private listings.
(h) Enforcement. Use of Shared Content outside this clause is a breach of these Terms and of the section headed MLS Data: Permitted Use, and may result in takedown, suspension or termination.

Section IV: Data Management, Privacy & Cybersecurity

4.1 Data Usage, Retention & Deletion
PropertyList.es collects and processes personal data to provide services, comply with legal obligations, and support legitimate operational purposes. Users have the right to access, correct, and request deletion of their personal data, subject to mandatory legal obligations and justified business needs (for example: fraud prevention, tax, accounting, or contractual records).

Upon account closure, PropertyList.es will delete personal data that is no longer necessary for the purposes for which it was collected in a timely manner and in accordance with the retention periods set out in our Privacy Policy. Certain categories of data may be retained for longer where required by law or necessary for legitimate business purposes; such retention periods and legal bases are set out in the Privacy Policy.

In the event of a personal data breach affecting user data, PropertyList.es will notify the Spanish supervisory authority (AEPD) without undue delay and, where feasible, within 72 hours of becoming aware of the breach. Where the breach is likely to result in a high risk to the rights and freedoms of affected users, PropertyList.es will also notify them without undue delay.


PropertyList.es acts as data controller for content uploaded by members, and as data processor for personal data processed on behalf of customers where applicable. The processing terms required by Article 28 GDPR are set out at clause 4.4 and apply automatically, so no separate agreement is needed. Where a Member’s own compliance process requires a signed document, PropertyList.es will consider a request made through MLS Support. The DPA describes processing purposes, security measures, subprocessors, international transfers (if any), and the obligations of each party.


4.2 Cybersecurity Measures
PropertyList.es employs state-of-the-art security protocols, including Cloudflare and other advanced measures, to protect user data. However, no system is entirely immune to risks, and absolute security cannot be guaranteed. Users are encouraged to take their own precautions to safeguard their accounts, such as using strong, unique passwords, enabling two-factor authentication where available, and regularly updating their login credentials. PropertyList.es is not liable for any unauthorised access or data breaches resulting from the user’s failure to adopt adequate security measures.

4.3 Marketing & Email Communication
By registering on PropertyList.es, users consent to receiving marketing emails, platform updates, and service notifications. Users may opt out at any time through their account settings or by contacting support or clicking opt out on emails.

4.4 Processing on behalf of Members (Article 28 GDPR)
(a) Roles. Where a Member uploads or enters personal data about their own clients and contacts (for example buyers, sellers, landlords, tenants and their representatives) and PropertyList.es processes it to provide the CRM and related Services, the Member is the controller and PropertyList.es is the processor. Where PropertyList.es determines the purposes and means of processing, including operating and securing the Platform, verifying Members, preventing fraud, publishing the public portal and its own marketing, PropertyList.es is the controller and this clause 4.4 does not apply. This clause 4.4, together with the Privacy Policy, is the written agreement required by Article 28(3) GDPR, and no separate agreement is necessary.
(b) Subject matter, duration, nature and purpose. The subject matter is the provision of the Services. Processing lasts for as long as the Member’s account is open, and afterwards only as set out in (j). The nature and purpose of the processing is hosting, storing, organising, retrieving, matching and transmitting Member data so that the Member can manage contacts, leads, listings, tenancies, documents and communications, and use the features they choose to enable.
(c) Types of personal data and categories of data subject. Typically: names, contact details, correspondence, property requirements and budget, viewing and transaction history, documents the Member uploads, and any other data the Member chooses to enter. Data subjects are the Member’s clients, prospects, tenants, landlords and their representatives and staff. Members must not enter special categories of personal data (Article 9 GDPR) into the Platform except where a feature is expressly provided for it.
(d) Instructions. PropertyList.es processes that personal data only on the Member’s documented instructions, which include the Member’s use and configuration of the Services and any instruction given through MLS Support, unless required otherwise by law, in which case PropertyList.es informs the Member before processing unless the law prohibits it. PropertyList.es will inform the Member if, in its opinion, an instruction infringes data protection law.
(e) Confidentiality. PropertyList.es ensures that persons authorised to process the data are bound by confidentiality obligations and receive appropriate data protection training.
(f) Security. PropertyList.es implements appropriate technical and organisational measures under Article 32 GDPR, taking into account the state of the art, the costs of implementation and the risks presented by the processing. The current measures are described in clause 4.2 and in the Privacy Policy.
(g) Sub-processors. The Member gives general authorisation for PropertyList.es to engage sub-processors. Each sub-processor is bound by data protection obligations no less protective than those in this clause, and PropertyList.es remains fully liable to the Member for their performance. The current sub-processors are listed in the Privacy Policy. PropertyList.es will give at least 30 days’ notice before adding or replacing a sub-processor. A Member may object on reasonable data protection grounds within that period, in which case the parties will discuss a resolution in good faith; if none is found, the Member may terminate the affected Services without penalty for the unused portion of any prepaid period.
(h) Assistance. Taking into account the nature of the processing and the information available to it, PropertyList.es will assist the Member, at the Member’s cost where the assistance is substantial: (i) by appropriate technical and organisational measures, in responding to requests from data subjects exercising their rights; (ii) in ensuring compliance with Articles 32 to 36 GDPR, including data protection impact assessments and prior consultation; and (iii) by notifying the Member without undue delay after becoming aware of a personal data breach affecting that Member’s data, with the information reasonably available to PropertyList.es.
(i) Data subject requests. Where PropertyList.es receives a request from a data subject that relates to a Member’s data, it will not respond directly except to acknowledge receipt and direct the request to the Member, unless legally required to respond or instructed by the Member.
(j) Deletion or return. On termination of the Services, and at the Member’s choice, PropertyList.es will delete or return the personal data processed on the Member’s behalf and delete existing copies, unless retention is required by law. Retention periods are set out in the Privacy Policy. Data held in routine backups is deleted in the ordinary course of the backup cycle.
(k) Information and audits. PropertyList.es will make available to the Member the information necessary to demonstrate compliance with this clause, in writing and within a reasonable period. Where that information is not sufficient, or following a personal data breach affecting the Member’s data, the Member or an auditor it mandates may carry out an audit, including an inspection, no more than once in any 12 month period unless required by a supervisory authority, on at least 30 days’ written notice, during business hours, subject to confidentiality and without unreasonable disruption. PropertyList.es may satisfy an audit request by providing a relevant third party certification or report where one exists.
(l) International transfers. Where personal data processed on the Member’s behalf is transferred outside the European Economic Area, PropertyList.es relies on an adequacy decision or on appropriate safeguards under Chapter V GDPR, including the European Commission’s Standard Contractual Clauses. The current transfers and recipients are described in the Privacy Policy.
(m) Member obligations. The Member warrants that it has a lawful basis for the personal data it enters into the Platform and for instructing the processing described in this clause, that it has provided the required information to its data subjects, and that it will keep its own records as required by Article 30 GDPR.

Section V: Payment & Subscription Policy

5.1 Credit Purchases & Subscription Model
Credits purchased on PropertyList.es are non-transferable outside of the purchasing agency and may not be sold, exchanged, or shared between different agencies or accounts. However, within an agency, credits may be shared with other users who hold “Can Feature” or “Admin” privileges, allowing them to use the credits for approved platform features (e.g., lead generation, premium listings). Any attempt to transfer or resell credits outside of these permitted conditions will result in immediate account suspension.
Credits are bought in bundles. Where a volume discount applies to a bundle, it is shown on the purchase screen before payment.

5.2 No Refund Policy (Credits, Subscriptions & Add-Ons)
Credits and subscriptions are non-refundable except as set out in this Section or as required by applicable consumer protection law. If PropertyList.es materially fails to provide a paid service (for reasons within our control) such that the service is unusable, users may submit a claim to MLS Support within 14 days of discovery providing detailed reproduction steps and logs. We will investigate and may issue platform credits or, where required by law, monetary refunds. Platform credits are the default remedy and will be applied at PropertyList.es’s discretion. This section does not limit statutory consumer rights.

5.3 Credit Expiration & Usage
Credits do not expire but can only be used for approved services within PropertyList.es.

5.4 Payment Methods & Pricing Changes
PropertyList.es reserves the right to update pricing for credits, subscriptions, or services. Users will be notified of pricing changes via email and through announcements on the Info Hub (info.propertylist.es) at least 30 days before changes take effect. Continued use of the platform after such notifications constitutes acceptance of the revised pricing. Payments are taken on the platform through our payment processor, Stripe, using major credit and debit cards. PropertyList.es is not responsible for fees or currency conversion charges imposed by third-party payment processors.

5.5 Affiliate and Advertising Disclosures
Some content or listings on the platform may be sponsored, and PropertyList.es may engage in affiliate marketing programs. All users should be aware that certain content may be sponsored or affiliated with third-party services. These disclosures will be clearly indicated on the relevant listings.
PropertyList.es may provide links to third-party websites or services for the convenience of users. These links are provided solely as a reference, and PropertyList.es does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services. Users access third-party links at their own risk, and PropertyList.es shall not be liable for any damages or losses arising from such use.

5.6 WhatsApp Group Policy & Advertising Guidelines
PropertyList.es maintains official WhatsApp groups as private communication and advertising channels designed exclusively for professional collaboration between verified real estate agencies and registered members. These groups are intended to facilitate the controlled sharing of property listings, buyer and agent requests, and time-sensitive professional communication relating strictly to real estate activities within Spain.
Participation in any official PropertyList.es WhatsApp group constitutes full acceptance of this policy, the PropertyList.es Terms of Use, and all applicable laws and regulations.

5.6.1 Group Access, Eligibility & Discretion
Access to official PropertyList.es WhatsApp groups is a discretionary privilege and not an entitlement.
Participation is strictly limited to Verified Agencies and authorised representatives in good standing whose PropertyList.es profiles remain fully verified, accurate, and compliant at all times.
Due to technical participant limits imposed by WhatsApp and the scale of the PropertyList.es network, access is granted subject to availability and at the sole and absolute discretion of PropertyList.es.
PropertyList.es reserves the unrestricted right to:

  • Grant or deny access
  • Prioritise certain agencies or users
  • Remove participants temporarily or permanently
  • Limit posting or advertising privileges
These actions may be taken without prior notice, justification, or refund, in order to:
  • Maintain professional standards
  • Manage capacity
  • Protect the integrity and security of the marketplace
  • Enforce compliance with this policy
Loss of verification status, account suspension, or breach of platform rules will result in immediate loss of WhatsApp group eligibility.

5.6.2 Code of Conduct & Prohibited Behaviour
All participants must behave professionally, respectfully, and lawfully at all times.

The following actions are strictly prohibited and may result in immediate removal or banning:
  • Posting content not directly related to real estate.
  • Spamming, flooding, excessive posting, or repeated messages
  • Posting misleading, false, outdated, or unverified property information
  • Sharing non-direct listings, fake listings, incorrect pricing, or inaccurate availability
  • Posting offensive, aggressive, discriminatory, defamatory, or abusive content
  • Attempting to sell or promote non-real-estate services or products
  • Promoting third-party platforms, tools, software, or competitors
  • Circumventing moderation or pinning procedures
  • Harassing, pressuring, or repeatedly contacting members after refusal
  • Using excessive emojis, all-caps messaging, or clickbait language
PropertyList.es reserves the right to remove any message or member deemed, at its sole discretion, to be disruptive, misleading, low-quality, or harmful to the community.

5.6.3 Posting Standards & Content Quality
To preserve clarity and usefulness, all shared content must meet minimum quality standards.
Posts must:
  • Relate exclusively to properties, buyer requests, or agent collaboration
  • Contain accurate pricing, location, and property details
  • Use professional language and formatting
  • Avoid exaggerated claims such as “urgent”, “last chance”, or misleading headlines
PropertyList.es may impose limits on posting frequency, reposting of the same property, or message volume per user.
Failure to comply may result in message deletion, posting restrictions, or removal from the group.
5.6.4 Direct Messaging & Lead Etiquette
Unsolicited direct messaging is strictly regulated.
Participants may not:
  • Send unsolicited sales, marketing, or promotional messages
  • Add group members to other WhatsApp groups, CRMs, or mailing lists
  • Persistently message users who have expressed disinterest
Private contact must be respectful, relevant, and consent-based.
Violations may result in immediate removal from WhatsApp groups and further platform sanctions.
5.6.5 Data Protection, Privacy & GDPR Compliance
All participants must comply fully with EU GDPR, Spanish data protection laws, and applicable privacy regulations.
It is strictly prohibited to:
  • Save, scrape, copy, export, or reuse phone numbers or personal data without explicit consent
  • Forward, screenshot, or share group messages or content outside the group
  • Use group data for marketing, lead harvesting, or external distribution
Each participant acts as an independent data controller for their own actions.
PropertyList.es bears no responsibility for misuse of personal data by group members.
5.6.6 Booking, Pinning & Paid Advertising
All pinned posts, promoted messages, or paid placements must be requested through MLS Support.
Requests must include:
  • The exact message text
  • Images or media
  • Links and references
Payment must be confirmed in full before any advert or promotion is published.
All advertising content is subject to review and approval. PropertyList.es reserves the right to reject, modify, delay, or remove any pinned content that violates policies or quality standards.
No refunds will be issued for content removed due to policy breaches.
5.6.7 Moderation Authority
WhatsApp groups are actively moderated.
Moderators have full authority to:
  • Delete messages
  • Issue warnings
  • Restrict posting privileges
  • Remove participants
Moderator decisions are final. PropertyList.es is under no obligation to provide explanations or engage in disputes regarding moderation actions.
5.6.8 Intellectual Property & Content Responsibility
Participants confirm that they own or have legal rights to all images, videos, descriptions, and materials shared.
PropertyList.es assumes no responsibility for copyright infringements, misrepresentation, or third-party claims arising from shared content.
5.6.9 Liability Disclaimer
PropertyList.es is not a party to any transaction, negotiation, or agreement arising from WhatsApp group interactions.
PropertyList.es:
  • Does not guarantee deal completion, lead quality, or buyer legitimacy
  • Is not liable for disputes, losses, damages, or misrepresentation between members
  • Does not verify transaction outcomes
All dealings occur at participants’ own risk.
5.6.10 Enforcement & Sanctions
Violations of this policy may result in one or more of the following actions:
  • Immediate or permanent removal from WhatsApp groups
  • Suspension or termination of PropertyList.es accounts
  • Loss of advertising, pinning, or promotional privileges
  • Reporting to agency owners or account administrators
Repeated or severe violations may result in permanent bans across the PropertyList ecosystem.
Appeals may be submitted to MLS Support; however, PropertyList.es is not obligated to reverse enforcement decisions.
5.6.11 WhatsApp Platform Compliance
All participants must comply with WhatsApp’s Terms of Service and Community Guidelines.
PropertyList.es is not responsible for WhatsApp account restrictions, bans, or enforcement actions imposed by WhatsApp.
5.6.12 Policy Updates
PropertyList.es reserves the right to amend or update this WhatsApp Group Policy at any time.
Continued participation in any official WhatsApp group constitutes acceptance of the latest version of this policy.
5.7 MicroSite and Website Builder
(a) Free MicroSite. Every agency receives a branded MicroSite, generated automatically from its listings and hosted at no cost as part of the free platform.
(b) Website Builder. The Website Builder is an optional paid upgrade providing a fully customisable site and the ability to use your own domain. The current rate is published on our pricing page and is charged in credits in accordance with clauses 5.1 to 5.4.
(c) Service commitment. By way of exception to clause 10.1, PropertyList.es targets 99.9% monthly availability for published Website Builder sites. If availability falls below this in a calendar month, the member may claim credits to the value of 10 EUR for each full day affected, up to the value of that month’s subscription fee. Claims must be submitted to MLS Support within 30 days of the affected period. A claim must identify the specific dates and times during which the site was unavailable. Our monitoring and server records are the authoritative measure of availability for the purposes of this clause. This commitment does not cover: scheduled maintenance notified in advance; events beyond our reasonable control as described in clause 10.4; and unavailability caused by the member’s own domain, DNS, registrar, or third-party integrations.
(d) Content responsibility. The member is solely responsible for all content published on their MicroSite or Website Builder site, including its accuracy, any third-party data or images used, and compliance with all applicable law. Clauses 3.1, 3.3 and 7.2 apply equally to this content.
(e) Domains. Where a member connects their own domain, the member is responsible for registering and maintaining that domain and its DNS configuration. PropertyList.es is not responsible for domain expiry, registrar suspension or misconfiguration outside its control.
(f) Cancellation and non-payment. If a Website Builder subscription is cancelled or lapses for non-payment, the agency’s web presence reverts to the free basic MicroSite. The paid site and its configuration are retained and are not deleted; the member may reactivate the Website Builder at any time by resubscribing, and the site becomes available again.

Section VI: Lead Generation & Quality Control

6.1 Lead Allocation & Response Time
PropertyList acknowledges that leads generated by an agent through their own external marketing or private tools are the exclusive professional assets of that agent. PropertyList does not share, sell, distribute, or reallocate these agent-sourced leads whatsoever.
(a) Agent-Sourced Leads: Leads brought directly to the platform by an agent (via their own marketing or personal networks) are the exclusive professional assets of that agent. PropertyList does not sell, share or distribute these leads and does not use them for its own marketing. Access is limited to what is necessary to provide, secure or support the service, or to comply with a legal obligation.
(b) PropertyList-Generated Leads:
Leads generated through PropertyList.es are subject to a 72 hour response rule, counted in calendar time from when the lead is delivered to the agent. If the listing agent does not respond within that period, the lead may be reallocated so that the end user receives a response.
6.2 Lead Verification & Refunds
PropertyList.es verifies that public portal leads are not from estate agents. Public portal leads are currently provided at no charge. PropertyList.es may introduce a pay-per-lead charge for public portal leads in future and will give notice before doing so. Where a lead has been paid for, if that lead is confirmed to be from an agent, any credits used to obtain it will be refunded into your account.
Agents must report the lead within 10 working days of purchase to MLS Support.
The reported lead will be reviewed, and if applicable, credits will be refunded to the agent’s account immediately.
Refund decisions are final and at the sole discretion of PropertyList.es.
6.3 Handling Low-Quality Leads
A “low-quality lead” is defined as:
Leads from estate agents.
  • Invalid or non-functional contact information.
  • Accidental submissions where the lead has no genuine intent to engage.
  • Bots
Users may report low-quality leads to MLS Support, and complaints will be reviewed on a case-by-case basis.
PropertyList.es reserves the right to issue credit refunds or blacklist certain lead sources if repeated issues occur.

Section VII: User Responsibilities

7.1 General Responsibilities
Users must ensure that all information provided on the platform is accurate and up to date, use the platform for lawful purposes, and comply with all applicable regulations. Users are also responsible for third parties accessing their account and must follow account security and integrity procedures described in Section 2.3.

7.2 Compliance with Applicable Laws
Users must comply with all relevant local, regional, and international regulations, including:
  • GDPR (for handling personal data)
  • Real estate licensing and advertising laws
  • Anti-money laundering (AML) regulations, where applicable
Users located outside Spain must comply with all applicable EU and national laws, including the GDPR and local data protection laws, professional licensing, and other regulatory requirements. PropertyList.es assumes no responsibility for ensuring compliance in the user’s country of operation
7.3 Use of Platform Tools and Services
Users must:
  • Use lead generation, listing, and promotional tools in good faith.
  • Avoid any form of abuse or manipulation of system algorithms, including repeatedly relisting or duplicating properties to gain exposure.
  • Refrain from interfering with or disrupting platform functionality.
Users are strictly prohibited from using automated systems, software, or ‘crawlers’ to scrape, harvest, or mine data from the Platform for any purpose, including the creation of competing databases or lead-harvesting. Any unauthorized data extraction will be treated as a security breach and may lead to legal action and permanent account termination.
MLS Data: Permitted Use
MLS listing data shared by members is provided solely to enable collaboration on live property transactions between verified members. It may not be used for any other purpose, including scraping, bulk export, building a competing database, or republishing members' listings on external sites, other than as expressly permitted by clause 3.9 (Marketing of Shared Listings by Other Members). Property feeds flow in from members, and any syndication of listings to external platforms remains under the control of the member who owns them. PropertyList.es reserves the right to suspend or terminate any account that misuses MLS data.
Users are strictly prohibited from using automated systems, bots, or ‘crawlers’ to scrape, harvest, or mine data from the PropertyList.es website or any of its tools including but not limited to the WhatsApp Groups, for any purpose, including lead harvesting or creating any type of databases.
7.4 Responsibility for Third Parties
If a user gives account access to a third party (e.g., employee, assistant, marketing partner), the primary account holder remains fully responsible for that third party’s actions under their account.
7.5 Duty to Review Terms
Users are responsible for reviewing the Terms & Conditions periodically and remaining informed of any updates or changes that may impact their use of the platform.

Section VIII: Member Conduct & Ethics

8.1 Code of Conduct
For conduct in official WhatsApp groups, members must also comply with Section 5.6. Violations may result in suspension, removal from groups, or account actions as described in Section 5.6.
8.2 Reporting Violations
Violations of platform policies can be reported through the provided support channels.
8.3 Zero Tolerance & Account Termination
Illegal activities, fraudulent behavior, or violations of these terms will result in immediate account termination. PropertyList.es actively monitors accounts for fraudulent activities, including but not limited to:
  • Fake listings.
  • Unauthorised lead reselling.
  • Misrepresentation of properties.
Accounts found in violation may be permanently suspended without prior notice.
Upon suspension for violation of these Terms, the following actions will occur immediately:
(a) Access to the Platform will be suspended;
(b) All active listings will be hidden from public view;
(c) Lead generation will be disabled (0 leads permitted); and
(d) All remaining account credits will be frozen pending the outcome of an investigation or appeal.
Frozen credits are non-refundable and cannot be transferred while an account is in a suspended state.
Appeal Process: If a user believes their account was wrongfully terminated, they may appeal the decision by contacting MLS Support.
Appeals will be reviewed on a case-by-case basis, and PropertyList.es retains sole discretion in determining the outcome.
8.4 Indemnity
The user agrees to indemnify, defend, and hold harmless PropertyList.es, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, losses, and expenses (including legal fees) arising from the user’s breach of these Terms, misuse of the platform, or violation of any applicable laws.
8.5 Inter-Agent Commission Sharing
When a listing agent specifies a commission percentage to be shared with a selling agent within a Listing, this constitutes a professional commitment. Members must honour these shared commission agreements. Failure to honour a stated commission agreement, or misrepresentation of commission splits, is considered a breach of professional ethics and may result in immediate removal from the Platform and all WhatsApp Groups and the wider PropertyList ecosystem.
8.6 Non-Disparagement
Members agree that they will not make, or encourage others to make, any false, malicious, or disparaging statements regarding PropertyList, its services, its employees, or other verified Members in any public forum, social media, or professional network. This is to maintain the professional reputation of the PropertyList ecosystem and its members.

Section IX: New Developments - Agent Access & Commission Protection

9.1 Free Access to Developer Inventory PropertyList.es provides registered agents with immediate, free access to a comprehensive portfolio of New Developments listed directly by Property Developers. Agents are granted a non-exclusive right to act as an external distribution channel, allowing them to promote these developments and share promotional materials directly with their private buyer lists at no additional cost.

9.2 The "Direct Handoff" & Mandatory Platform Booking When an agent secures a prospective buyer for a New Development, all viewings should be requested and coordinated directly through the PropertyList platform. By using our automated notification system, PropertyList.es creates an official, time-stamped record of the viewing request, the client registration, and the Developer's acceptance. This system record is essential as it acts as your concrete proof of the referral to guarantee your commission.

9.3 Ironclad Commission Entitlement (Paid once the buyer has paid 10%) PropertyList.es has structured its Developer agreements to heavily protect agent cash flow and separate marketing risk from construction risk.
For New Developments:
Liquidity Aligned: The agent's commission is fully earned and becomes payable once the Buyer has paid 10% or more of the purchase price to the Developer and those funds have irrevocably cleared into the Developer's bank account. Agents do not have to wait for the completion of the construction to be paid.
Absolute Finality (Irrespective of Outcome): Once that payment has cleared, the agent's service is deemed 100% complete. The commission is strictly non-refundable. If the transaction subsequently fails for any reason - including buyer withdrawal, failure to secure financing, or the Developer cancelling the project - the agent's commission remains fully earned and protected.

9.4 Lead Entitlement If an agent generates a lead that is transmitted to a Developer via the Platform's automated notification mechanism, the agent is entitled to the agreed commission for any purchase made by that specific buyer within that same development (whether it is the originally inquired unit or a different phase) for a 24 month period after the confirmed viewing.

9.5 Commission Disputes & Platform Enforcement PropertyList.es acts as a shield to protect its agents from non-paying Developers, though it does not act as legal counsel:
• Evidentiary Support: The Platform tracks and records all direct lead handoffs. In the event of a dispute, PropertyList.es will provide the agent with time-stamped system records, referral logs, and automated notification emails. Under our Developer Agreements, these records constitute prima facie evidence of the referral and the agent's entitlement to the commission.
• Platform Sanctions: If a Developer fails to pay an agent's invoiced commission within five (5) Business Days, PropertyList.es reserves the right to immediately suspend the Developer’s access, hide their active listings from the public portal, and block any future buyer leads until the agent is paid in full.
• Legal Proceedings & Costs: While PropertyList.es will aggressively apply platform sanctions, PropertyList.es is not an arbiter of legal disputes and is under no obligation to initiate or fund court proceedings on behalf of the agent. The agent is solely responsible for initiating their own legal action to recover unpaid funds. However, agents are advised that under the Platform's Developer Agreement, Developers who pay late are automatically liable for interest (ECB rate + 8%), and all reasonable recovery costs and attorney’s fees incurred by the agent in enforcing the payment.

Section X: Disclaimers & Limitations of Liability

10.1 Platform Availability & Uptime
PropertyList.es operates on a best-effort basis. While we aim for high availability, we provide no uptime guarantee unless explicitly set out in a separately executed SLA addendum. Users acknowledge that interruptions and maintenance may occur and that PropertyList.es is not liable for downtime except as otherwise provided by a signed SLA.
10.2 Liability Limitations
PropertyList.es is not liable for:
  • Errors, omissions, or inaccuracies in listings.
  • Unauthorised account access.
  • Business losses due to platform outages.
  • Any bugs, viruses, or malicious software.
Users agree to use the platform at their own risk and acknowledge that PropertyList.es does not guarantee uninterrupted service or error-free operation.
10.3 No Guarantee of Results
While PropertyList.es provides tools to generate leads, users are solely responsible for their business outcomes. The platform does not guarantee the quality, success, or financial return of any leads, transactions, or business interactions.
10.4 Force Majeure
PropertyList.es will not be held liable for any delays, failures, or disruptions in service due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, war, government actions, strikes, technological failures, or cyberattacks.
10.5 Changes to the Platform & Termination of Services
PropertyList.es reserves the right to modify, discontinue, or change any aspect of its services at any time without prior notice. Users will not receive compensation or credits if services are discontinued.
Exception: If a user has paid for a feature that is still ongoing and has not been fulfilled at the time of discontinuation, PropertyList.es will issue a prorated refund or credits at its sole discretion.
10.6 Limitation of Liability for Loss of Profit
PropertyList.es shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of business profits, revenue, or data, even if PropertyList.es was advised of the possibility of such damages.
11.1 Jurisdiction & Dispute Resolution
These Terms are governed by the laws of Spain. The parties shall attempt to resolve disputes in good faith by negotiation or mediation. If the dispute is not resolved within 90 days of written notice, the dispute will be finally resolved as follows:
(a) Business Users (B2B): Any dispute between commercial parties shall be submitted to binding arbitration administered by a recognised arbitration institution in Spain, in accordance with its rules. The seat of arbitration shall be Marbella, Málaga, Spain, and proceedings shall be conducted in English unless the parties agree otherwise. The tribunal will consist of a single arbitrator unless the applicable rules require otherwise.
(b) Consumers (B2C): Consumers retain the right to bring claims before courts with jurisdiction under applicable law. Nothing in these Terms shall deprive a consumer of mandatory rights under consumer protection laws.
Class Actions & Small Claims: Parties waive rights to participate in class-actions or collective proceedings for B2B disputes; consumers retain any mandatory rights to collective procedures as provided by law. Either party may pursue qualifying claims in small claims courts where permitted by law.
All disputes arising under these Terms shall be governed by Spanish law. Foreign agencies may submit to Spanish jurisdiction or arbitration as indicated herein, without prejudice to mandatory rights under their national law.

11.2 Compliance with Local, EU & International Regulations
Users must comply with all applicable local, EU, and international laws and regulations, including GDPR and the Digital Services Act (DSA). Users are solely responsible for ensuring compliance with legal requirements related to their real estate activities, including data protection, fair housing laws, and consumer rights legislation. PropertyList.es is not liable for users’ failure to comply.
11.3 Licensing & Permits
Users must hold all necessary licences, permits, and tax registrations required to operate legally. Upon request, users must provide proof of compliance. Failure to provide documentation may result in account suspension or termination. In addition to tax and registration documentation, all Members are required to maintain active Professional Indemnity Insurance covering their real estate activities. PropertyList may request proof of such insurance at any time. Failure to maintain or provide proof of coverage may result in account suspension.
11.4 Right to Modify Terms
PropertyList.es may modify, amend, or revise these Terms at any time. Significant changes will be communicated via email, and the updated Terms will be posted on the platform. Users are responsible for periodically reviewing the Terms to stay informed of updates. Continued use after notification constitutes acceptance of the revised Terms.
11.5 Severability Clause
If any provision is found invalid, illegal, or unenforceable, the remaining provisions remain in full force. The invalid provision will be replaced by a valid provision that closely reflects the original intent.
11.6 Entire Agreement Clause
These Terms, together with referenced policies (e.g., Privacy Policy), constitute the entire agreement between the user and PropertyList.es regarding the platform. They supersede all prior agreements. Users should periodically review these Terms to ensure they understand their rights and obligations. Any amendments must be made in writing and agreed upon by both parties.

If a user’s issue has not been resolved to their satisfaction, they may escalate the matter by contacting a senior representative of MLS Support or the PropertyList.es legal team for further resolution.
