Plusvalía coefficients change on 1 December 2026, if Royal Decree-law 29/2026 survives: what it means if you sell in Marbella

Plusvalía municipal is the council tax on the land-value gain when you sell or inherit a property. Part of the formula is a coefficient, set by how many years you have held the property. A decree published on 07-10-26 resets the maximum coefficients from 1 December 2026. That date depends on a vote that has not happened.

What changes, and what has to happen first

Royal Decree-law 29/2026 (BOE-A-2026-20823) has been in force since 08-10-26. Its article 10 says the new maximum coefficients apply with effect from 1 December 2026 ("con efectos desde el 1 de diciembre de 2026"). A decree-law needs validation by Congress within 30 days of enactment. Because the Cortes are dissolved, that falls to Congress's standing committee, the Diputación Permanente (articles 78 and 86 of the Constitution). As of 08-10-26 we found no vote date.

The coefficients in force today are the 2024 table from Royal Decree-law 8/2023, article 24. Later updates (RDL 9/2024, RDL 16/2025 and RDL 26/2026) were annulled when Congress rejected them. If RDL 29/2026 is repealed before 1 December, the 2024 table stays. The decree only resets the maximums. We found no exemption or abolition in it.

The new maximums are higher for every holding up to 16 years and lower from 17 years. The biggest rises are at 9 and 10 years (0.10 each). The biggest cut is at 20 years or more (0.10).

What it means in Marbella

Marbella's rate is 29%, according to the council's 2023 ordinance file. A 2023 amendment in the council's public file, whose final publication we could not verify, says to apply the legal maximum coefficient in force at each moment. If that text is still current, Marbella follows whichever table applies. Confirm with the council that it is.

You can ask the council to use your real gain instead if that is lower (article 107.5 of the local taxes law). Then the coefficient does not set your bill. The deeds of purchase and sale do. A sale at no gain is not taxed if you declare it and prove it with the deeds (article 104.5).

If you are selling

The date that counts is the date of the transfer, normally the day the deed is signed (article 109.1.a of the local taxes law). A sale completed before 1 December uses today's table. One completed on or after 1 December uses the new table, if the decree survives. We will update this post when the vote is held.
