On January 2, 2025, Spain took a significant step towards regulating holiday rentals with the launch of its National Register for Short-Term Rentals. Registration has been mandatory since 1 July 2025. If you are advertising a short-term or seasonal let without a registration number, you are already outside the rules.

If you’re renting out a property for short-term stays, here’s what you need to know.

Why Is Registration Important?

Any property offered for short-term rentals needs a Unique Identification Number. This rule applies to all types of rentals, including houses, apartments, individual rooms, and even boats used for holiday stays.

How to Register:

To obtain your registration number, visit the Spanish Land Registries Association website. Your local Land Registry will issue the number, which will also appear on your property’s Nota Simple (Land Registry report).

What Do Property Owners Need to Do?

Owners are required to:

    • Provide property details: Submit essential information, including identification, property type, capacity, and cadastral reference.

    • Keep information accurate: Ensure that all registered details remain up-to-date.

    • Avoid penalties: since 1 July 2025, failure to register can lead to fines under state, regional or local rules, and platforms have been required to verify registration numbers and pull unregistered adverts since 20 May 2026 (EU Regulation 2024/1028).

Common Reasons for Registration Refusal

While the process may seem straightforward, applications can be denied for several reasons:

    • Prior cancellations: If your property’s registration was previously canceled by regional authorities, the application may be rejected.

    • Community restrictions: Statutes from your Community of Owners could block approval if they prohibit or limit holiday rentals.

    • Address discrepancies: Mismatches in property address records can cause delays or refusals.

    • “Under construction” status: If your property is still listed as incomplete in the Land Registry, you won’t receive a rental number - even if the building has been finished for years.

A New Rule for Community Authorisation

Express authorisation from the Community of Owners is required for new tourist lets. Since 3 April 2025, Ley Orgánica 1/2025 amended the Ley de Propiedad Horizontal to require approval by a three-fifths majority of the community. It does not apply retroactively to tourist lets already lawfully established and registered before that date.

Spain’s National Register for Short-Term Rentals has been mandatory since 1 July 2025, and the number has to appear in every advert on every platform, PropertyList included. Registering the property is only the first duty: for every stay you must also send guest data to the police within 24 hours and keep it for three years (RD 933/2021) - see guest registration with the police.

It’s wise to begin the process early to avoid any last-minute complications or fines. Keep in mind that approval isn’t guaranteed, as discrepancies or restrictions can lead to rejection. However, by addressing any issues promptly, property owners have a chance to successfully register their rental properties.
