On January 2, 2025, Spain took a significant step towards regulating holiday rentals with the launch of its National Register for Short-Term Rentals. While the platform is already active, registration becomes mandatory starting July 1, 2025, giving property owners time to meet the new requirements.

Why Is Registration Important?

Any property offered for short-term rentals needs a Unique Identification Number. This rule applies to all types of rentals, including houses, apartments, individual rooms, and even boats used for holiday stays.

How to Register:

To obtain your registration number, visit the Spanish Land Registries Association website. Your local Land Registry will issue the number, which will also appear on your property’s Nota Simple (Land Registry report).

What Do Property Owners Need to Do?

Owners are required to:

    • Provide property details: Submit essential information, including identification, property type, capacity, and cadastral reference.

    • Keep information accurate: Ensure that all registered details remain up-to-date.

    • Avoid penalties: Starting July 1, 2025, failure to register may lead to fines under state, regional, or local regulations.

Common Reasons for Registration Refusal

While the process may seem straightforward, applications can be denied for several reasons:

    • Prior cancellations: If your property’s registration was previously canceled by regional authorities, the application may be rejected.

    • Community restrictions: Statutes from your Community of Owners could block approval if they prohibit or limit holiday rentals.

    • Address discrepancies: Mismatches in property address records can cause delays or refusals.

    • “Under construction” status: If your property is still listed as incomplete in the Land Registry, you won’t receive a rental number—even if the building has been finished for years.

A New Rule for Community Authorisation

Express authorisation from the Community of Owners is now required by some registries. Starting April 3, 2024, this rule applies to newly registered tourist homes but may also affect older registrations retroactively. If this happens, lodging an appeal is highly recommended.
